A summary provided by Milwaukee County District Attorney John Chisholm details the events that resulted in the Feb. 2 fatal shooting of Alvin Cole by Wauwatosa Police Officer Joseph Mensah. Cole was shot less than three minutes after police began to chase him through the parking lot of Mayfair mall.
Chisholm announced Wednesday he would not charge Mensah, concluding the officer acted in self-defense.
5:43 p.m. Cole enters the mall. He is carrying a 9 mm semi-automatic pistol in a shoulder bag.
A few minutes after 5:43 p.m. Cole confronts a man in the mall whom he believed was laughing at him. Cole begins to follow the man and displays a gun. Cole walks away. The man and his nephew continue through the mall. Police are called for a “domestic” dispute with a gun possibly involved.
Officers arrive and speak with the man, who gives them a description of Cole.
Approximately 6:03 p.m. Officers spot Cole and two others, who matched a description of those involved in the argument.
6:05 p.m. Officers begin to chase Cole, another male and a female through the parking lot, yelling for them to stop. The female stops and puts her hands up. Cole and the other male continue running.
6:06 p.m. The two males run through the parking lot of The Cheesecake Factory, pursued by a squad car.
Fourteen seconds later. An officer says he heard a shot and saw a muzzle flash near Cole
Six seconds after that. Mensah fires five shots toward Cole, who is in a kneeling position with a gun in his hand. The male who was with him is arrested. Mensah walks away. Other officers provide first aid to Cole, who was later pronounced dead.
